Statutory Authority
OSA was given authority under Title 22, Chapter 1603 of the Maine Statute to establish and operate the Prescription Monitoring Program. The goal of the program is to provide information to both Prescribers (Physicians, Dentists, Optometrists, etc.) and Pharmacists to identify suspicious activity related to prescribing and dispensing of schedule II-V controlled substances.
Unlawful Disclosure
According to Title 22, Chapter 1603, "a person who knowingly releases, obtains, or attempts to obtain information from the program in violation of Chapter 1603 shall be punished by civil fine". All data obtained from this site should be treated as PHI data and handled in accordance with all federal and state laws regarding such. The HIPPA privacy laws affect the disclosure of any data that is obtained from the PMP and this website. All data should only be used for the intended purpose of monitoring a patient's prescriptions and is not to be shared with anyone not authorized to see it. If you are unsure of whom you can share this PMP/PHI data with, please contact OSA.
Access to Information
According to Title 22, Chapter 1603, Prescribers may access the information in the database "to the extent the query relates to a current patient of the practitioner to whom the practitioner is prescribing or considering prescribing any controlled substance". Dispensers also may access information "to the extent the information relates to a current patient to whom the pharmacist is dispensing or considering dispensing a controlled substance".
User Account and Password Your User Name and Password should not be shared with anyone. You agree to keep your User Name and Password private and secure and not to share it with anyone. Your User Name and Password is used to submit and request PMP data, GHS will use your User Name to track all of your data submission and report requests. If you feel that someone other then yourself is using your User Name to access PMP data, contact GHS or OSA immediately to get the account disabled.
Contracted Account Agreement
By utilizing the system, you agree to the above terms regarding the use of this website and any PHI data obtained from this website or GHS in any form. You hereby agree to follow the security and password policies of the Prescription Monitoring Program. You agree to not disclose nor misrepresent any data or protected health information to any unauthorized person or party. Agreeing to these terms does NOT GRANT you permission to receiving PMP data from the site, all user information will be verified before access is granted.You also agree to indemnify, defend, and save harmless OSA, GHS and their employees from any and all claims, costs, expenses, injuries, liabilities, losses and damages of any kind and description resulting from or arising out of ANY improper use of any PMP/PHI data obtained from this site. This indemnification does not extend to any claims, costs, expenses, injuries, liabilities, losses or damages arising from negligence or unlawful act on the part of OSA or GHS.
